Welcome to Selby, owned by GSM ALCHEMY SDN BHD (“GSM ALCHEMY,” “Selby,” “we,” “us,” or “our”), a Malaysia-based provider of premium skincare products. These Terms and Conditions (“Terms”) govern your use of our Website, selby.com.my (“Website”), and your purchase of products from us, whether through the Website, in-store, or via authorized retailers. By accessing our Website or purchasing our products, you agree to be bound by these Terms. If you do not agree, please refrain from using our Website or purchasing our products.
- General Provisions
1.1 Scope of Terms. These Terms apply to all interactions with our Website and purchases of Selby skincare products, whether made online, in-store, or through authorized third-party retailers in Malaysia.
1.2 Acceptance of Terms. By placing an order, you confirm your acceptance of these Terms and agree to comply with them. Do not place an order if you do not agree to these Terms.
1.3 Statutory Rights. Nothing in these Terms affects your statutory rights under the Consumer Protection Act 1999 (Malaysia) or other applicable Malaysian laws.
1.4 Language. These Terms are available in English and Bahasa Malaysia. No other languages apply to these Terms.
1.5 Amendments. We may amend these Terms from time to time. The version applicable to your order is the one posted on our Website at the time of purchase. Please review the Terms before placing an order.
1.6 Eligibility. You confirm that you are at least 18 years old and legally capable of entering binding contracts. We reserve the right to terminate your access to the Website or cancel orders if we discover you are under 18.

2.3 Definition of Writing. References to “writing” or “written” in these Terms include emails and SMS.
- Contract Formation
3.1 Order Acceptance. A contract is formed between you and GSM ALCHEMY when your payment is successfully processed, and we send you an order confirmation email with your order number.
3.2 Order Rejection. We may reject your order if:
- Products are out of stock;
- There are unexpected resource limitations;
- Payment issues arise (e.g., credit card errors);
- We identify errors in pricing or product descriptions; or
- We suspect fraudulent activity or a breach of these Terms.
If we cannot accept your order, we will notify you, and no charges will be applied.
3.3 Order Number. We will assign an order number upon receiving your order request. Please include this number in all communications regarding your order.
3.4 Geographic Restriction. Our Website is intended for the promotion and sale of products in Malaysia only. Orders for delivery outside Malaysia will not be processed.

4.1 Product Descriptions. We strive to ensure that product descriptions, including ingredients and usage instructions, are accurate. However, we do not guarantee that all information is error-free. Contact our Customer Service team for clarification before use.
4.2 Product Variations. Images on our Website are for illustrative purposes only. Due to differences in device displays, product colours or packaging may vary slightly from those shown.
4.3 Product Use. Our skincare products are for personal, non-commercial use only. You may not resell, distribute, or modify our products without our prior written consent. Always follow the usage instructions provided. We are not liable for adverse reactions resulting from misuse or failure to conduct a patch test.
4.4 Health Disclaimer. Our products are not intended to diagnose, treat, cure, or prevent any medical conditions. Discontinue use and consult a healthcare professional if you experience adverse reactions.
- Pricing and Payment
5.1 Pricing. Product prices are displayed in Malaysian Ringgit (MYR) on the Website at the time of order and include all applicable taxes unless otherwise stated. Delivery fees, if applicable, are additional and will be shown during checkout.
5.2 Price Accuracy. We take reasonable care to ensure pricing accuracy. If an error is discovered after your order is placed, we will notify you promptly and may cancel the order, providing a full refund if payment has been made.
5.3 Payment Methods. We accept payments via credit/debit cards (Visa, MasterCard), authorized Referral Points (as defined in Section 14), and other methods specified on the Website. Referral Points may be used to cover up to 100% of the order value, including delivery fees. Referral Points are promotional in nature and have no cash surrender value. Payment must be made in full at the time of order.
5.4 Payment Authorization. By submitting payment, you confirm that you are the authorized user of the payment method and that the provided payment information is accurate. We are not responsible for verifying payment authorization or for issues arising from inaccurate payment details.
5.5 Incorrect Receipts. If you believe a receipt is incorrect, contact our Customer Service team promptly (see clause 2.1).
- Delivery
6.1 Delivery Service. We use third-party delivery services to ship products to the address you provide during checkout. Delivery is available only within Malaysia. We do not ship to P.O. boxes, parcel lockers, or parcel pick-up service addresses for security reasons.
6.2 Delivery Costs. A standard delivery fee applies to all orders as indicated during checkout, unless a ‘Free Shipping’ promotion is active.
6.3 Delivery Times. Estimated delivery times, calculated from order confirmation, are:
- Peninsular Malaysia: 2–5 business days
- East Malaysia: 3–7 business days
Delivery may take longer during promotional periods, public holidays, or due to unforeseen circumstances (e.g., extreme weather, third-party courier delays).
6.4 Delivery Responsibility. You are responsible for providing an accurate and complete delivery address. We and our third-party delivery service are not liable for delays or failed deliveries due to incorrect or incomplete address information.
6.5 Risk and Ownership. Risk of loss or damage to products passes to you upon delivery. Ownership transfers once we receive full payment.
6.6 Signature Requirement. A signature is required upon delivery to confirm receipt. Our third-party delivery service is not responsible for verifying the identity of the recipient.
6.7 Delivery Issues. If delivery fails due to your absence, our third-party courier will attempt to rearrange delivery. If you receive incorrect or damaged products, notify our Customer Service team within 3 days of receipt.
6.8 Suspension of Delivery. For health and safety reasons (e.g., confirmed or suspected infectious disease cases at the delivery address), we may suspend and rearrange delivery at our discretion. Our Customer Service team will contact you to coordinate.
6.9 No Guaranteed Delivery Times. While we and our third-party couriers strive to meet estimated delivery times, these are not guaranteed. We are not liable for delays caused by third-party couriers or events beyond our control (e.g., extreme weather, third-party courier delays).
- Returns and Refunds
7.1 Return Policy. We accept returns of unopened, unused products in their original packaging within 14 days of receipt, subject to our Return Policy. Used or damaged products are not eligible for return unless defective or incorrect.
7.2 Return Process. To initiate a return, contact our Customer Service team (see clause 2.1) for instructions. You are responsible for return shipping costs unless the product is defective or incorrect.
7.3 Refunds. Refunds for eligible returns will be processed to the original payment method within 10 business days of receiving the returned product. If an order was purchased using a combination of cash/card and Referral Points, the refund will be pro-rated: the monetary portion will be refunded to the payment card, and the redeemed points will be credited back to your account with their original expiration date. Points cannot be refunded as cash. Refunds for defective or incorrect products will include any applicable delivery fees.
7.4 Promotional Offers. If a return involves products purchased as part of a promotional offer (e.g., multi-buy or free gift), we may adjust the refund to reflect the full price of retained items.
7.5 Final Decision. All returns and refunds are subject to GSM ALCHEMY’s final approval, in compliance with the Consumer Protection Act 1999 (Malaysia).
- Suspension of Supply
8.1 Reasons for Suspension. We may suspend product supply to:
- Address technical issues or make minor product changes;
- Comply with changes in laws or regulations; or
- Address stock shortages or other operational constraints.
8.2 Customer Rights. If we suspend supply and the product remains unavailable, you may cancel your order and receive a full refund for any payments made.
- Liability
9.1 Exclusions. We do not exclude or limit liability for:
- Death or personal injury caused directly by our negligence;
- Fraud or fraudulent misrepresentation;
- Breach of your statutory rights under the Consumer Protection Act 1999; or
- Defective products under applicable Malaysian law.
9.2 Limitation of Liability. Except in cases of wilful misconduct or gross negligence, we are not liable for indirect, consequential, or incidental damages, including loss of profits, goodwill, or business opportunities, arising from your use of our Website or products.
9.3 Aggregate Liability. Our total liability for any claim related to your order, whether in contract, tort, or otherwise, shall not exceed the purchase price of the products in question.
9.4 Third-Party Delivery. We are not liable for delays, losses, or damages caused by third-party delivery services, except where required by law.
9.5 Force Majeure. We are not liable for delays or failures to perform due to events beyond our reasonable control, including natural disasters, pandemics, or third-party service disruptions.
- Intellectual Property
10.1 Ownership. All content on our Website, including trademarks, logos, designs, text, images, and product formulations, is owned by or licensed to GSM ALCHEMY and protected by Malaysian and international intellectual property laws. You may not reproduce, modify, or distribute this content without our prior written consent.
10.2 User-Generated Content. By submitting content (e.g., reviews, photos) to our Website or email, or social media platforms we make available, you grant GSM ALCHEMY a nonexclusive, royalty-free, worldwide license to use, display, and reproduce such content for marketing and business purposes. You warrant that your content does not infringe third-party rights or violate applicable laws.
- Privacy
11.1 Privacy Policy. Your personal information is handled in accordance with our Privacy Policy, available at selby.com.my. By using our Website or purchasing products, you consent to the collection and use of your information as described therein.
- Dispute Resolution
12.1 Informal Resolution. If you have a complaint, please contact our Customer Service team (see clause 2.1) to seek a resolution.
12.2 Governing Law. These Terms are governed by the laws of Malaysia.
12.3 Jurisdiction. Any disputes arising from these Terms or your use of our Website or products shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12.4 Arbitration Option. At our discretion, disputes may be resolved through arbitration under the Asian International Arbitration Centre (AIAC) Rules. Arbitration shall be conducted in Kuala Lumpur, Malaysia, in English, and the decision shall be binding.
- Miscellaneous
13.1 No Third-Party Rights. These Terms are between you and GSM ALCHEMY. No other person has rights to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
13.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
13.3 Entire Agreement. These Terms, together with our Privacy Policy, Return Policy, and order confirmation, constitute the entire agreement between you and GSM ALCHEMY regarding your purchase of products.
13.4 Assignment. We may assign our rights and obligations under these Terms. You may not assign your rights without our written consent.
13.5 Business Use Exclusion. Our products are for personal, non-commercial use only. We are not liable for any losses arising from commercial use, including loss of profit or business interruption.
- Referral Program Terms
14.1 Program Structure
14.1.1 Overview. The Selby Referral Program allows registered customers (“Referrers”) to earn reward points (“Referral Points”) by referring friends (“Referees”) to purchase products on selby.com.my.
14.1.2 Eligibility. To participate as a Referrer, you must have a registered account and have completed at least one (1) valid, non-returned purchase. Referees may be new or existing customers who use a valid referral code during checkout.
14.2 Earning Points (The Calculation)
14.2.1 Base Calculation. Referral Points are calculated based on the final cash amount paid by the Referee (excluding taxes, but including delivery fees if applicable).
14.2.2 Variable Reward Rate. To ensure fair pricing and sustainability, the reward rate is dynamic. The Referrer earns 10% of the Referee’s purchase value, subject to a Maximum Combined Margin of 19%.
• Formula: Reward % = Lower of [10%] OR [19% – (Discount % used by Referee)].
• Example 1: Referee pays full price (0% discount). Reward = 10%.
• Example 2: Referee uses 11% off coupon. Reward = 8% (19% – 11%).
• Example 3: Referee uses 20% off coupon. Reward = 0% (Points are not awarded on deeply discounted orders).
14.2.3 Conversion. The resulting value is credited as points where 100 Points = RM 1.00.
14.3 Point Vesting and Validity
14.3.1 Pending State. Points are initially credited as “Pending” upon the Referee’s purchase.
14.3.2 Vesting Period. Points remain Pending for 14 days (matching our Return Policy window). If the Referee does not return the product within this window, points become “Active” on the 15th day.
14.3.3 Forfeiture. If the Referee returns their order or requests a refund, the associated Pending points are immediately forfeited.
14.3.4 Expiration. Active points expire 12 months from the date they are earned. Expired points cannot be reinstated.
14.4 Redemption
14.4.1 Usage. Points may be used to pay for products and delivery fees on the Website.
14.4.2 Value. Points are redeemed at a rate of 100 Points = RM 1.00.
14.4.3 No Caps. You may use points to pay for up to 100% of an order’s total value.
14.4.4 No Cash Value. Referral Points are non-transferable and cannot be exchanged for cash, cheque, or bank credit.
14.5 Anti-Fraud
14.5.1 Conduct. GSM ALCHEMY reserves the right to review and investigate all referral activities. We may suspend accounts or revoke points if we notice suspicious activity, including but not limited to: self-referrals (referring yourself using different emails), high-volume scripted referrals, or broadcasting codes on coupon aggregation sites. - Contact Us
